Terms of Sale

Payment for goods must be made as indicated. We accept all forms of cash as well as Visa/Mastercard. Rugs will be shipped prepaid by insured carrier and are the property of the purchaser. Any/all claims are the responsibility of the purchaser.  KY law requires shipping be indicated on each invoice. You will be billed for shipping only if this charge has been added to your total. Shipping charges as indicated on invoice will be deducted from all refunds. All returns must be shipped on or before the last day of approval period ( if not stated, 5 days) for credit. For an extension please call before the end of the approval period.  The consignee accepts responsibility for all items received. Returned items are to be free of dirt, stains, grease, tears, and any animal/pet damage including, but not limited to: bites, pulls, chews, moth or beetle infestations, pet urine, vomit, etc. All tags must be attached and intact. No return on SALE items.

The customer hereby grants to JAX Rugs, 109 Parkway
Berea, KY (“Secured Party”) a security interest in all merchandise taken out on approval, consignment, or sale, as described by item number, name, and/or size above.   If the customer should sell or otherwise dispose of the item, or default in any of his/her duties, then JAX Rugs shall have all of the remedies of a Secured Party under the Uniform Commercial Code of Kentucky.  Customer shall pay all expenses of repossession and sale, including reasonable attorney’s fees. Venue for all disputes will be Madison County, Kentucky. Payment for services (cleaning, repair, or appraisal) is due upon receipt. JAX is not responsible for goods left over 30 days.
